1. About AJ Domaines
This website, its private membership platform and the related online services are operated by:
A.J DOMAINES SAS
10 Route de Giscours
33460 Labarde
France
SIRET: 320 528 037 00056
Email: contact@ajdomaines.com
Telephone: +33 (0)5 57 97 09 09
In these Terms, “AJ Domaines,” “we,” “us” and “our” refer to A.J DOMAINES SAS.
2. Scope and acceptance
These Terms of Service govern:
- access to and use of the AJ Domaines website and private membership platform;
- the creation and use of member accounts;
- participation in the AJ Domaines membership programme;
- purchases made through the Website;
- and, where applicable, bookings for visits, tastings, events or other services.
Before placing an order, you must read and expressly accept these Terms by selecting the corresponding checkbox during checkout.
The Terms applicable to an order are those displayed and accepted when the order is submitted. We recommend retaining a copy of them for your records.
Our Privacy Policy explains how AJ Domaines collects and processes personal data and should be read alongside these Terms.
Where mandatory provisions of the law applicable to a consumer grant greater protection than these Terms, those mandatory provisions shall prevail.
3. Eligibility and legal drinking age
The Website is intended for persons legally capable of entering into a binding contract.
Alcoholic beverages may only be purchased by persons aged 18 or over and who have also reached the minimum legal age required to purchase alcohol in the country of delivery.
By creating an account or placing an order, you confirm that you satisfy these requirements.
We may request reasonable evidence of age or identity before accepting an order or completing delivery. An order may be refused or cancelled where satisfactory evidence is not provided.
Products must not be purchased for, supplied to or accepted on behalf of a minor.
4. Member accounts
Certain areas of the Website are accessible only through a personal account.
When creating or activating an account, you agree to provide accurate, complete and current information. You must update that information whenever necessary.
You are responsible for keeping your login credentials confidential and must not share your account with another person.
Please notify us promptly at contact@ajdomaines.com if you suspect that:
- your account has been accessed without authorisation;
- your password has been compromised;
- or the information associated with your account is no longer accurate.
You remain responsible for activity carried out through your account to the extent permitted by applicable law.
We may temporarily restrict access to an account where reasonably necessary to investigate suspected fraud, misuse or a security incident.
5. Private membership programme
AJ Domaines operates a private membership programme through which selected members may access wines, allocations, events, visits, content and other benefits.
Membership may be offered by invitation or according to eligibility criteria determined by AJ Domaines.
Membership is personal. It may not be transferred, sold, shared or used on behalf of another person without our prior written agreement.
Continued membership is conditional upon purchasing, during each membership year, wines representing at least twelve 750 ml bottle equivalents. All formats are counted on a 750 ml bottle-equivalent basis; for example, one magnum counts as two bottles and one double magnum as four bottles.
For these purposes, the applicable membership year is the annual period communicated to the member when membership is activated or renewed.
If the annual purchase requirement is not met, AJ Domaines may decline to renew or may discontinue membership at the end of the applicable membership year. This will not affect orders already accepted or any mandatory consumer rights.
Membership includes one private visit per membership year at either Château Giscours or Caiarossa for the member and up to three guests. Visits must be arranged in advance and are subject to availability.
Members also benefit from priority access to selected events, harvest experiences, and lunches or dinners at the estates, subject to prior arrangement and availability. With the exception of the annual private visit included in membership, all such experiences are charged separately. The applicable price and booking conditions will be communicated before any booking is confirmed.
Wines purchased through the membership programme are intended for personal enjoyment and private cellars and must not be acquired for commercial resale.
Membership does not guarantee:
- access to every wine or vintage;
- any minimum allocation;
- renewal of a previous allocation;
- access to every event or experience;
- or the continuation of a particular benefit.
Certain offers may be subject to limited availability, purchase limits, eligibility conditions or specific booking terms disclosed when the offer is made.
We may evolve the programme and its benefits over time. Material changes affecting an active paid benefit, should paid membership services be introduced, will be communicated in accordance with applicable law.
We may suspend or terminate membership where a member:
- materially breaches these Terms;
- attempts to circumvent allocations or purchase limits;
- uses several accounts to gain an unfair advantage;
- engages in fraudulent or unlawful conduct;
- acquires or resells wines, allocations or member-only benefits for unauthorised commercial resale;
- or compromises the security or integrity of the programme.
Any such measure will be proportionate to the circumstances and will not affect mandatory consumer rights or orders already validly accepted.
6. Products and availability
The principal characteristics of each product, including the estate, wine, vintage, format and quantity, are displayed on the relevant product page.
Please review this information before placing an order.
We take reasonable care to ensure that product descriptions and images are accurate. However, photographs are illustrative and colours may vary according to screens, lighting and photographic conditions.
Minor variations in labels, capsules, cases or packaging that do not affect the identity or quality of the product do not constitute non-conformity.
All products are offered subject to availability.
The selection offered through the Website is curated by AJ Domaines and evolves according to releases, availability and stock levels. Wines, vintages and formats may be offered for limited periods or while stocks last.
Allocations may include En Primeur wines, exclusive formats and selected wines offered on a pre-sale basis. Offers generally feature wines from current stock that are available for delivery.
Certain wines may be sold through:
- member allocations;
- limited releases;
- quantity restrictions;
- invitation-only collections;
- or time-limited offers.
We may impose reasonable purchase limits per person, account, household, payment method or delivery address to ensure fair access to scarce products.
Where a product becomes unavailable after an order has been submitted, we will inform you promptly. We will not substitute another product, vintage or format without your express agreement.
7. Prices, taxes and import charges
Prices are displayed in the currency indicated on the Website.
Before you confirm an order, the checkout page will show:
- the price of the selected products;
- applicable taxes;
- delivery charges;
- and the total amount payable to AJ Domaines.
Prices and offers may change at any time. Such changes do not affect orders already accepted.
For deliveries outside the territory in which taxes and import charges are collected by AJ Domaines, the recipient may be required to pay customs duties, import taxes, clearance charges or local fees imposed by the destination country.
Where such charges are not included at checkout, they are not collected by AJ Domaines and remain payable to the relevant authority, carrier or intermediary.
The customer is responsible for checking any local restrictions affecting the importation, possession or delivery of alcoholic beverages. We may refuse a destination or cancel an order where shipment would be unlawful or impracticable.
8. Orders and contract formation
The presentation of products on the Website constitutes an invitation to place an order and not an unconditional offer by AJ Domaines.
Before submitting an order, you can review its contents and correct input errors.
By selecting the final order button, you:
- submit an order with an obligation to pay;
- confirm that the information provided is accurate;
- and accept these Terms.
After receiving the order, we will send an electronic acknowledgement, which may be labelled “Order Confirmation”. This message confirms receipt of the order but does not, by itself, necessarily mean that the order has been accepted.
The sales contract is formed when AJ Domaines sends confirmation that the order has been accepted or, at the latest, when the products are dispatched.
For contracts concluded electronically with a value of EUR 120 or more, AJ Domaines will retain the contractual record for the period required by applicable law and will provide the customer with access to it upon request.
We may refuse or cancel an order before acceptance where:
- a product is unavailable;
- a purchase or allocation limit has been exceeded;
- payment cannot be authorised;
- the delivery destination is unavailable or legally restricted;
- the customer does not satisfy the age requirements;
- fraud or unauthorised activity is reasonably suspected;
- or the Website contains an obvious pricing or product-description error.
Where an obvious error affects an order, we will contact you before acceptance and offer you the choice of confirming the order with the corrected information or cancelling it.
Any amount already collected for a refused or cancelled order will be refunded promptly through the original payment method.
9. Payment
Available payment methods are displayed during checkout.
Payment transactions are processed through Stripe and the payment services integrated with Commerce7. AJ Domaines does not receive or store complete payment-card numbers.
You confirm that:
- you are authorised to use the selected payment method;
- the payment details provided are accurate;
- and sufficient funds or credit are available.
The payment method may be authorised or charged when the order is submitted, depending on the payment process displayed at checkout.
We may postpone acceptance or dispatch until payment has been successfully authorised.
Payment providers, card issuers or banks may apply their own authentication, fraud-prevention and security procedures.
10. Delivery
We deliver only to destinations and addresses accepted during checkout.
Available delivery methods, charges and estimated times are displayed before the order is confirmed.
Delivery estimates are not guaranteed dates unless expressly identified as such. Nevertheless, orders will be delivered within the period agreed with you or, where no specific period has been agreed, within the period required by applicable consumer law.
Selected wines offered on a pre-sale basis and En Primeur wines can be dispatched only once they have become available for delivery.
Paid storage is available exclusively for eligible En Primeur wines and is subject to separate written storage arrangements confirmed by AJ Domaines. Further information is set out on the En Primeur Storage page.
You must provide an accurate and complete delivery address and any information reasonably required by the carrier.
An adult satisfying the applicable legal-age requirements may be required to accept and sign for delivery.
Where delivery fails because:
- the address supplied is incorrect or incomplete;
- no eligible recipient is available after reasonable delivery attempts;
- the recipient refuses the package without lawful grounds;
- or the shipment is not collected within the carrier’s stated period,
we may recover reasonable additional delivery, return or storage costs, to the extent permitted by law.
For consumer orders, the risk of loss or damage generally passes when you, or a third party designated by you other than the carrier, physically takes possession of the products.
Ownership passes only after full payment of all amounts due, without affecting the statutory rules governing the transfer of risk.
11. Receipt of orders and damaged products
Please inspect the package and products promptly after delivery.
Where a package is visibly damaged, you should, where reasonably possible:
- record precise reservations on the carrier’s delivery document;
- take photographs of the package and affected products;
- retain the packaging;
- and contact us promptly at contact@ajdomaines.com.
These practical steps help us investigate the claim but do not remove or reduce any mandatory statutory right.
Please provide:
- your order number;
- a description of the issue;
- photographs where relevant;
- and details of the affected products.
Where damage, shortage or non-conformity is established, we will provide the remedy required by applicable law, which may include replacement, price reduction or refund.
12. Right of withdrawal
12.1 Consumer right of withdrawal
Where you purchase as a consumer and the statutory right of withdrawal applies, you may withdraw from the sales contract without giving a reason within 14 days after the day on which you, or a third party designated by you other than the carrier, receives the products.
For a single order delivered separately, the period begins when the final product is received.
The right of withdrawal may be exercised by sending us an unambiguous statement by email or post before the period expires.
You may use the model withdrawal form at the end of these Terms, although this is not mandatory.
The European framework governing distance sales provides consumers with a 14-day withdrawal period and requires clear pre-contractual information on its conditions and exercise.
12.2 Exceptions
The right of withdrawal does not apply where an exception provided by applicable law is satisfied, including, where relevant:
- goods made to the consumer’s specifications or clearly personalised;
- sealed goods that are unsuitable for return for health-protection or hygiene reasons once unsealed;
- services fully performed before the end of the withdrawal period following the consumer’s express request and acknowledgement, where the legal requirements are satisfied;
- or alcoholic beverages whose price was agreed when the contract was concluded, whose delivery can only take place after 30 days, and whose value depends on market fluctuations beyond the trader’s control.
The mere fact that a product is wine does not, by itself, remove the statutory right of withdrawal.
12.3 Effects of withdrawal
You must return the products within 14 days after communicating your decision to withdraw.
Unless AJ Domaines agrees otherwise, the direct cost of returning the products is borne by the customer.
Products must be returned:
- complete;
- unopened;
- in a condition allowing their resale;
- and, where reasonably possible, in their original protective packaging.
You are responsible only for any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the products.
We will refund the amounts received for the returned products and the cost of the least expensive standard delivery method initially offered, where required by law.
Additional costs resulting from your choice of a more expensive delivery method are not refundable.
We may withhold reimbursement until we have received the returned products or you provide evidence that they have been sent back, whichever occurs first.
Refunds will normally be made using the original payment method.
13. Returns and refunds
Before returning a product, please contact contact@ajdomaines.com so that we can provide the appropriate return instructions and address.
Unless the product is defective, damaged or non-compliant, you are responsible for packaging it safely and for the return transport.
Products should not be returned to a carrier, winery or estate address without prior instructions.
The right of withdrawal is separate from your rights relating to defective, damaged or non-compliant products. Exercising a legal guarantee does not require you to rely on the right of withdrawal.
14. Legal guarantees
Consumers benefit from the mandatory legal guarantees provided by the law applicable to the sale, including the French legal guarantee of conformity and the guarantee against hidden defects where French law applies.
These guarantees apply independently of any commercial gesture or voluntary guarantee.
Where a product is non-compliant, the consumer may request the remedies available under applicable law. Depending on the circumstances, these may include replacement, price reduction or termination of the sale and refund.
Nothing in these Terms restricts or excludes these mandatory rights.
The following statutory notice is reproduced in French in accordance with Article D. 211-2 of the French Consumer Code:
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
15. Experiences and events
AJ Domaines may offer visits, tastings, dinners, events or other experiences through the Website.
The description, date, location, price, capacity and conditions applicable to an experience will be displayed when it is offered.
Certain experiences may be subject to separate cancellation terms due to:
- limited capacity;
- advance preparation;
- the involvement of external providers;
- catering arrangements;
- or a fixed performance date.
Those specific conditions will be communicated before booking and will prevail for the relevant experience where they differ from these general provisions.
Participants must comply with reasonable safety, conduct and access instructions communicated by AJ Domaines or the relevant venue.
AJ Domaines may refuse to serve alcohol to any person where required by law or reasonably necessary for safety.
16. Website use
We grant you a limited, personal, non-exclusive and revocable right to access and use the Website for lawful, private purposes.
You must not:
- use the Website fraudulently or unlawfully;
- attempt to gain unauthorised access to an account or system;
- interfere with the operation or security of the Website;
- introduce malicious code;
- impersonate another person;
- use automated tools to scrape or systematically extract content or data;
- circumvent membership, allocation or purchase restrictions;
- or use the Website in a manner that infringes the rights of AJ Domaines or another person.
We may take proportionate measures to prevent or address misuse, including restricting access, suspending an account or cancelling an order before acceptance.
17. Intellectual property
The Website and its content are protected by intellectual property laws.
This includes, without limitation:
- names and trademarks;
- logos and visual identities;
- photographs and videos;
- texts and product descriptions;
- designs and illustrations;
- technical materials;
- Website structure and layout;
- and downloadable content.
Such content is owned by AJ Domaines, its affiliated estates or the relevant licensors.
You may view and use the Website for your personal, non-commercial purposes.
You may not reproduce, modify, distribute, publish, sell, license, extract or commercially exploit any protected content without the prior written permission of the relevant rights holder, except where applicable law expressly permits such use.
No right or licence is granted by implication.
18. Third-party services
The Website relies on third-party technical services, including Commerce7 and Stripe, and may contain links to independent websites or platforms.
Those third parties may apply their own terms and privacy policies to services they provide directly.
AJ Domaines does not control independent third-party websites and is not responsible for their content, availability or practices.
This does not affect AJ Domaines’ responsibility for its own obligations as seller or data controller.
19. Liability and force majeure
AJ Domaines remains liable for the proper performance of its contractual obligations in accordance with applicable law.
Nothing in these Terms excludes or limits liability:
- for death or personal injury caused by negligence;
- for fraud or fraudulent misrepresentation;
- for gross negligence or wilful misconduct;
- for breach of mandatory consumer rights;
- or where liability cannot lawfully be excluded or limited.
AJ Domaines is not responsible for loss caused solely by:
- the customer’s breach of these Terms;
- incorrect information supplied by the customer;
- improper storage or handling after delivery;
- normal evolution of wine that does not constitute non-conformity;
- or an unforeseeable and unavoidable act of a third party.
Neither party will be liable for failure or delay caused by an event satisfying the legal requirements of force majeure.
Where such an event affects an order, AJ Domaines will inform the customer and take reasonable steps to limit its effects. If performance becomes impossible or is delayed beyond a reasonable period, the customer may exercise any cancellation or refund rights available under applicable law.
20. Personal data
Personal data collected through the Website is processed in accordance with the AJ Domaines Privacy Policy.
The Privacy Policy explains, among other matters:
- what information we collect;
- why and how it is used;
- the recipients of that information;
- applicable retention periods;
- international transfers;
- and your data-protection rights.
Where consent is legally required for optional cookies or marketing communications, it will be requested separately.
21. Suspension and termination
You may stop using the Website and request closure of your account at any time.
We may suspend or close an account where reasonably justified by:
- a material breach of these Terms;
- fraudulent or illegal conduct;
- repeated non-payment;
- misuse of the membership programme;
- a serious security risk;
- or a legal obligation.
Where appropriate, we will provide notice and an opportunity to remedy the breach before closing the account, unless immediate action is necessary.
Account closure does not cancel orders already accepted or obligations that arose before closure.
Certain information may continue to be retained where required for accounting, tax, legal, fraud-prevention or dispute-management purposes, as explained in the Privacy Policy.
22. Changes to these Terms
We may amend these Terms to reflect changes in:
- applicable law;
- our services;
- Website functionality;
- payment or delivery processes;
- or the membership programme.
The updated version will be published on the Website with a revised effective date.
Changes do not apply retroactively to orders already accepted unless required by law or expressly agreed with the customer.
Where a material change affects an ongoing paid service or membership, appropriate notice will be provided.
23. Governing law and dispute resolution
These Terms and contracts concluded through the Website are governed by French law.
Where you are a consumer resident in another country, this choice of law does not deprive you of any mandatory protection granted by the law of your habitual residence.
In the event of a complaint, please contact us first at:
contact@ajdomaines.com
We will seek to resolve the matter amicably.
If the complaint remains unresolved after a prior written approach to AJ Domaines, a consumer may refer the dispute free of charge to the consumer mediator appointed by AJ Domaines.
Consumers may also use any other dispute-resolution mechanism available under mandatory law.
Any dispute not resolved amicably or through mediation may be brought before the court having jurisdiction under applicable law.
No clause in these Terms requires a consumer to bring proceedings exclusively before the courts located at AJ Domaines’ registered office.
24. General provisions
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
Failure or delay by AJ Domaines in exercising a right does not constitute a waiver of that right.
Headings are included for convenience and do not affect the interpretation of these Terms.
These Terms and any specific conditions expressly communicated and accepted before an order or booking constitute the contractual documentation for the relevant transaction. The Privacy Policy should be read alongside these Terms and explains how personal data is processed.
In the event of inconsistency, specific conditions expressly accepted for a product, allocation, delivery or experience prevail over these general Terms for that particular transaction.
